Yaffe will be back in court on July 15 with a motion to dismiss the charges against him. He's already won a return of all his business licenses, including the permit to sell tobacco products.
In the interim, Krefetz says, "They're trying to starve Matt out of business. He has rent, he has bills, and he is unable able to make any money."
"We're taxpayers," adds Toni. "How can they shut down anyone's business in this economy?"
Boston Police District 14 Captain James Hussey did not return numerous Phoenix calls for comment.
